Far Reaching Implications For Consumers of Online Music Services
New York, New York (July 1, 2003) – Friskit, Inc., a technology licensing company focused on enabling consumers to conveniently find, personalize and play streaming media, filed suit in Chicago, Illinois Friday, June 27th, against RealNetworks (Nasdaq:RNWK) and privately-held Listen.com for patent infringement.
The suit cites RealNetworks' RealOne Player Plus and Listen.com's Rhapsody service for infringement based on their use of Friskit’s core technology and key features. RealOne Player Plus is the basis of RealNetworks' player and subscription product lines. The suit potentially encompasses revenues from sales of both the players and subscription products.
If Friskit succeeds in obtaining a permanent injunction, RealOne and Rhapsody could be prevented from offering a number of critical features, such as the ability for consumers to incorporate streaming media in personalized playlists, or to listen to a set of songs sequentially and continuously. The suit exposes RealNetworks to potentially millions of dollars of damages.
“We’ve spent years and millions of dollars developing and patenting the most convenient ways for consumers to find, personalize and play streaming media over networks,” said George Aposporos, Chairman and CEO of Friskit. “Most other patents cover pieces of solutions – not what's fundamental to the beginning of a new industry."
The Growth of Music and Media Subscription Services
Music and media subscription services have been described as critical to the
success of the music business, which is supporting them as an alternative to
free file-swapping services like Morpheus and Kazaa. The ease and convenience
of choosing and accessing music, and other media like film, videos, animation,
speeches, and much more from networks like the Internet, Intranets, or wireless
networks, are already key to success in the rapidly expanding field of on-demand
media subscription services.
On-demand media subscription services and other developing digital media services are projected to grow significantly over the next four years. According to a survey published by Jupiter Research, paid content will grow at an annual rate of more than 20 percent until 2007, when it will reach $5.4 billion. An illustration of this growth is the announcement by Apple (Nasdaq: AAPL) that music fans have downloaded over five million songs from the iTunes® Music Store in its first eight weeks.
